Terms of Service

These Terms of Service ("Terms") govern your use of the Jukbox mobile application and related services (the "Service"), operated by Julian Overton ("Jukbox," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Jukbox. By using the Service you represent that you meet this requirement and that the information you provide is accurate. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.

2. Your account

You are responsible for keeping your login credentials secure and for all activity under your account.
You must provide a valid email address and a unique username. We may reclaim usernames in cases of impersonation, inactivity, or abuse.
Notify us promptly of any unauthorized use of your account.
You may delete your account at any time from Settings inside the app.

3. Your content

"User Content" means anything you post or send through the Service, including reviews, ratings, rankings, lists, comments, profile details, and messages. You retain ownership of your User Content. By posting it, you grant Jukbox a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content solely to operate and promote the Service. You are solely responsible for your User Content and represent that you have the rights to post it and that it does not violate these Terms or any law.

4. Acceptable use

You agree not to use the Service to:

Post content that is unlawful, harassing, hateful, threatening, defamatory, sexually explicit involving minors, or that promotes violence or self-harm.
Harass, bully, impersonate, stalk, or threaten any person.
Post spam, scams, or misleading content, or artificially manipulate votes, momentum, or rankings.
Infringe anyone's intellectual property or privacy rights.
Scrape, crawl, reverse engineer, or attempt to gain unauthorized access to the Service or its data.
Interfere with or disrupt the Service or attempt to circumvent security or rate limits.

5. Objectionable content and abusive users (zero tolerance)

Jukbox does not tolerate objectionable content or abusive behavior. By using the Service you agree that there is no tolerance for objectionable, abusive, or harassing content or conduct.

You can flag and report objectionable content or users from within the app.
You can block any user, which hides their content and prevents them from contacting you.
We review reports and remove offending content and eject abusive users within 24 hours.
We may filter, remove, or restrict content and suspend or terminate accounts at our discretion to keep the community safe.

6. Moderation, suspension, and termination

We may remove any content and suspend or terminate any account that violates these Terms or that we reasonably believe poses a risk to the Service or its users, with or without notice. You may stop using the Service and delete your account at any time.

7. Third-party music data and intellectual property

The Service displays music information and cover art supplied by third-party providers including Spotify, Genius, and Last.fm. That content belongs to its respective owners and is provided subject to those providers' terms. Jukbox claims no ownership of third-party music content. The Jukbox name, logo, design, and software are owned by us and may not be used without permission. Spotify, Genius, and Last.fm are trademarks of their respective owners and are not affiliated with or endorsing Jukbox.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that music data supplied by third parties is accurate or complete.

9. Limitation of liability

To the maximum extent permitted by law, Jukbox and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the past twelve months or twenty US dollars.

10. Indemnification

You agree to indemnify and hold harmless Jukbox and its operators from any claims, damages, or expenses arising out of your User Content, your use of the Service, or your violation of these Terms or any law.

11. Changes to the Service and these Terms

We may modify or discontinue features at any time. We may also update these Terms; when we do, we will post the updated version here and revise the "Last updated" date. Your continued use of the Service after changes take effect means you accept the revised Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in New York, and you consent to their jurisdiction, except where prohibited by applicable law.
